These Terms of Use govern your access to and use of MedSavingz.com and the prescription-savings information, free discount-card access, registration, customer-support and messaging services made available through the site (collectively, the “Services”). MedSavingz.com is operated by K1 Health LLC (“K1 Health,” “MedSavingz,” “we,” “us,” or “our”).

1. Nature of the Services

MedSavingz provides general prescription-savings and discount information and makes a third-party pharmacy discount card available after registration. The discount card is not insurance. MedSavingz and K1 Health LLC are not pharmacies, insurers, pharmacy benefit managers or medical providers and do not prescribe, dispense or recommend medications.

Savings, participating pharmacies, pricing and availability are controlled by third parties and can vary. No particular savings amount or pharmacy price is guaranteed.

2. Registration and card access

You may register by providing accurate contact information. You must be at least 18 years old. No payment information or date of birth is required through the standard registration form. Successful registration gives you access to the included prescription discount card page. SMS consent is not required to access the card.

3. SMS program terms

Account/service SMS: If you separately opt in, MedSavingz may send recurring account/service messages related to your registration, card access, support requests and service updates. Message frequency varies. Message and data rates may apply.

Marketing/promotional SMS: If you separately opt in to marketing, MedSavingz may send recurring marketing and promotional messages about prescription savings, pharmacy and health/medical discounts, wellness-related offers and savings promotions. Messages may be sent using automated technology. Message frequency varies. Message and data rates may apply. Marketing consent is not a condition of purchase, registration or receiving the free prescription savings card.

By opting in to either SMS program, you confirm you are the subscriber or customary user of the number provided or otherwise have authority to consent. Reply STOP to a MedSavingz text to opt out or HELP for help. You may also use our Opt Out page or email support@medsavingz.com. A one-time confirmation may be sent after opt-out.

Mobile numbers and SMS opt-in information are not sold or shared with third parties for their own marketing purposes. Service providers may process information as necessary to operate messaging and requested services, subject to our Privacy Notice.

4. Acceptable use

You may not misuse the site, submit false information, interfere with security, attempt unauthorized access, infringe intellectual-property rights or use the Services in violation of law.

5. Medical disclaimer

Content on MedSavingz is general information only. It is not medical advice, diagnosis, treatment or a recommendation to start, stop or change a medication. Consult an appropriate licensed healthcare professional about medical questions and medication decisions.

6. Third-party discount card and services

The Optum Perks card and related marks, identifiers and program information are third-party materials. K1 Health LLC and MedSavingz do not control third-party pharmacy participation, processing, pricing or discount results. Third-party terms may also apply to use of the card.

7. Disclaimers and limitation of liability

To the fullest extent permitted by law, the Services are provided “as is” and “as available” without warranties of uninterrupted operation, error-free content, particular savings, availability or fitness for a specific purpose. To the fullest extent permitted by law, K1 Health LLC and MedSavingz will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages arising from the Services. Nothing limits liability that cannot lawfully be limited.

8. Intellectual property

MedSavingz original branding, text, graphics and site materials are protected by applicable law. Third-party names, marks and discount-card materials remain property of their respective owners.

9. Privacy

Our Privacy Notice explains how information is collected, used, disclosed, retained and protected.

10. Changes

We may update these Terms or the Services. Revised Terms will be posted with an updated date.

11. Governing law

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles, except where applicable law requires otherwise.
